surveyDescriptionState of Vermont Windsor County ss In Re: discontinuance of Part of Town Highway 50 as a Highway, continuance as a trial The above entitled matter came on for hearing before the Selectman of the Town of Hartland on the 23 rd day of September, A. D. 1961, pursuant to notice thereof in the following form. Where as, petition has been filed to discontinue as a highway and lay out as a trail that part of Highway No. 50 between the house formally owned by Fred Rice and now owned by Canaday, and the intersection of Highway No.48 with Highway No. 50. Which Highway was laid out by the Selectman of Hartland as shown in the Town proceedings, Vol. 4 page 50 & 51, therein described as follows; beginning at the Northwest corner of David Rice’s new barn, thence south 64 deg east 22 rods to a stake and stones; thence South 59 deg east 21 rods and 19 links to a stake 1 foot North of a small maple tree; thence South 67 ½ deg East 8 rods to a stake; thence North 66 deg East 9 rods 10 links; thence South 37 deg 10 rods to the road near Nathan Kitridge house in said road, surveyed on the South side and laid 3 rods wide. Now, therefore, notice is hereby given that the Selectman of the Town of Hartland will meet at Damon Hall in the Town of Hartland at 10:00 o’clock in the forenoon, Saturday September 23 rd 1961, for the purpose of hearing parties interested and for examining the premises to determine whether the described highway should be discontinued as a Town Highway, whether the highway should be continued as a trail and for the determination of any other facts required by law to be determined under the petition. Dated at Hartland in the County of Windsor and State of Vermont, this 8th day of September A. D. 1961. Louis E Maxfield Kenneth J Murphy Selectman Notice in writing was sent by registered mail to each of the signers of the petition in this matter, namely, Mary R Canaday, Marjorie C Morley, Ernest Lovett Gardner, and Philip S Garceau on September 9, 1961 and return receipts were duly received from each addressee. At the hearing there were present: Sidney N. Hammond, Louis Maxfield, and Kenneth J. Murphy, the Selectman of the Town of Hartland: Donald Frail, Town Manager: Mary Canaday and Frank Canaday, Petitioners and owners of abutting properties; Elizabeth Sherburne, Attorney for M & Mrs. Canaday , Max Rogers Town Clerk: Lewis E Springer Jr. Town agent and Attorney. Upon hearing Parties and examination of the highway, it is found 1. That part of the Town Highway No. 50 running from the former Fred Rice residence (originally David Rice) to the intersection thereof with Town Highway No. 48, as described in the Town Proceedings Volume 4, Page 50 & 51 is now impassable by vehicle traffic for some years and is needed and wanted by horseman as a trail. 2. The abutting owners desired to have the highway Altered in Status to that of a trail, and they have no objection to its discontinuance as a highway if it is continued as a trail 3. Other Property owners on the highway, namely, Garceaus, are petitioners, and have no need for the continuance of the part of the highway described in the petition and in the notice of the hearing as a highway, but they do desire the highway altered in status to that of a trail. 4. The public convenience and necessity no longer required the continuance of the highway as a highway, but is required it’s continuance as a trail. It is, therefore, Ordered that Town Highway No. 50 running from the former Fred Rice’s residence to the intersection thereof with the Town Highway No. 48 , as described in Town Proceedings, Vol. 4, page 50 & 51, is hereby discontinued as a Town Highway and is constituted as a Trail.
